The site accessible via the url www.almain.com (hereinafter the “Site”) provides legal and practical information concerning Almain.

It is published by Almain, an Association d’Avocats à Responsabilité Professionnelle Individuelle (association of lawyers with individual professional liability), registered with the Paris Trade and Companies Register under number 813 709 441, whose registered office is at 240, bis boulevard Saint-Germain, 75007 Paris, France and whose telephone number is 01 85 09 12 22.

The publication director is Mr Edgard Nguyen, Managing Partner.

The Site is hosted by Gandi SAS, a French Société par Actions Simplifiée with a share capital of € 300,000, whose registered office is located at 63-65 boulevard Massena, 75013 Paris, France and whose telephone number is 00 +33 (0)1 70 37 76 61.

Protection of personal data

When using the Site, Almain will process certain personal data concerning users. This processing is carried out in compliance with the General Data Protection Regulation no. 2016/679 of 27 April 2016, the Law no. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties and Almain’s Privacy Policy which can be accessed here.

Intellectual property

The user of the Site acknowledges that the entire Site and all of its content, including, but not limited to, the architecture of the Site and all texts, articles, information, photographs, videos, images, illustrations (including or not personal data), software, trademarks and logos included in the Site (hereinafter referred to as the “Content”) are protected by intellectual property law and are the full and complete property of Almain or are licensed to Almain.

Almain grants the user a license to (i) access and use the Site and (ii) download documents that are made available free of charge via the Site, in the form of electronic files specifically identified as being available for downloading. It is specified that the license thus granted to the user is a non-exclusive, revocable, personal, non-assignable, non-transferable and non-sublicensable license for the whole world.

With the exception of the foregoing, it is strictly forbidden for users to:
copy, reproduce, represent, disseminate, distribute and publish, permanently or temporarily, all or part of the Content and/or the Site by any means and on any medium known or unknown to date,
create derivative works from the Content and/or the Site,
modify, translate, adapt or arrange all or part of the Content and/or the Site,
disassemble, decompile or reverse engineer the Site,
use a robot, in particular a spider, a website search or retrieval application or any other means to retrieve or index all or part of the content of the Site, unless expressly authorised in advance by Almain.

In any event, users are solely responsible for the use they make of the documents, information and personal data provided via the Site. The user undertakes to make personal use of said documents, information and personal data and undertakes not to distribute said documents, information and personal data to third parties or to re-exploit or re-use said documents, information and personal data, in whole or in part, without citing Almain. In particular, it is specified that data relating to Almain members (in particular photographs and professional data) made accessible via the Site may not be collected or processed without the prior written consent of the person concerned. In particular, all users must refrain from collecting and using this data, either manually or automatically, to send messages or make advertising calls of any kind.

In accordance with article L.122-4 of the French Intellectual Property Code, any representation or reproduction not expressly authorised, in whole or in part and by any process whatsoever, is illegal and constitutes an infringement punishable by articles L.335-2 et seq. of the French Intellectual Property Code.

Liability

Almain undertakes to do its utmost to ensure that the Site is accessible 24 hours a day, 7 days a week. However, Almain makes no commitment as to the availability and permanent accessibility of the Site, and does not guarantee that the Site is error-free. Almain may be forced to temporarily interrupt access to the Site, in particular for technical maintenance purposes, without incurring any liability whatsoever.

It is also specified that the Internet network and computer and telecommunications systems are not error-free and that interruptions and malfunctions may occur. Almain provides no guarantee in this respect and cannot be held liable for any damage resulting from the use of the Site, the Internet network and computer and telecommunications systems. Almain, its directors or employees may not be held liable for any damage whatsoever resulting from a connection to this Site, which the user makes under his or her sole responsibility.

The Site may contain links to websites managed by third parties (hereinafter the “Third Party Sites”). These Third Party Sites are independent from the Site and Almain does not edit or control the sources or content of these Third Party Sites or their links to other sites. Applicable law and jurisdiction
